I've been working with ZWicker & Associates since September last year. The payment arrangemnts were setup for 12 months. Now they are saying that they are getting ready to go into litigation. Is it legal for them to sue me if I have a payment plan setup with them.




They can sue. But it's gonna look really stupid to the judge, if you're on a plan and current with the payments.

I am with unc here, the judge is not going to be happy with screwing around with this case when payments are made every month. I think the judge has better things to do than mess with this.

I'm current since they process a phone check every month out of my account which I understand now is a big no no.

I guess the key in this case is the payment plan will be reviewed in September. If they refuse to continue with the payment plan what would my options be -- I'm really trying to stay away from bankruptcy.

I dunno why they'd have a problem with you, let alone sue. As Dave Ramsey is fond of saying, "they're not gonna put a bullet in a horse that's linping."
