SonicPayday attempting to get my employer in wage assignment

I apologize, I'm not sure if I am doing this right. However I had an issue with Sonic Payday attempting to get my employer to volunteer in wage assignment. However they do not participate in this type of program. I never received anything relating to the wage assignment and was unaware until I was notified by my employer today. What is my recourse with Sonic? Can you help me?




Send Sonic a wage revocation letter. From my understanding, they can't enforce a wage assignment because it has to be signed in person.

Tina, do you have the contract copy from Sonic? Review the fine print very carefully and see if the clause of wage assignment has been clearly mentioned in it. It is also necessary that you should acknowledge the contract by signing it in person. Digital signatures are not valid for making the wage assignment legal.

I have seen others bringing the page below to attention when talked about wage assignment. I think it is a valuable piece of information and the word should be spread largely.

I have a loan from Sonic through Cash Transfer Centers. I read the contract and I saw nothing that said that could "assign" wages.

well, I've never done a payday loan, so I could most definitely be wrong about this, but I thought getting the employeer to assign wages, had to be court ordered? or is there usually some fine print that allows them to do this? I know garnishments are court ordered. But am I hearing that in this case, they can get the employer to assign wages if employer will participate? sometimes this payday stuff seems so foreign to me, it seems that they have their own set of rules. A "wage assignment" is an agreement, "signed" by you, allowing the loan company to request that your employer withhold a portion of your earnings and send them to the loan company. Because this is a voluntary agreement, it is also fully revokable. Meaning, that even if your company participated in such activities, you can present your payroll department with a letter revoking the agreement and they cannot sent any of your money to the loan company.

Wage garnishment is ordered by the court after the loan company takes you to court. You would receive offical notice of such legal actions.

There is a company that deals with consolidations of payday loans. You would have to join and then request that some of the members PM you that information, as it is against forum rules to post it here.

Thank you for all your help advice. Does anyone have experience with Sonic Payday in regards to defaulting on payment? Since my employer does not accept the wage assignment from them, is there next recourse court?

When they find out that your employer doesn't accept wage assignment, they will threaten to turn it over the 3rd party collections. Their collection agency is Universal Fidelity. Sonic likes to scare people, but from what I have learned, they aren't getting very good results with people who know their rights under the fdcpa laws and fight back.

notell39, after reviewing the contract very thoroughly, you found that 'wage assignment' has not been mentioned in it. In such a case, if Sonic tries to deduct money from your payroll, it will be against the legal norms of wage assignment process. Send a revocation letter to Sonic at their mailing address and send a ???notice of defense' to your employer. Send these letters through certified mail with return receipt requested and keep a copy documented in your file. Doing this, you will have covered your bases legally and restrict the company from deducting money from your pay stub. If they still try with such actions, you will require some legal counseling.

I've found that with PRL, Sonic sister company, that when I faxed and mailed the wage revocation letter, they never tried to get my employer to assign wages. They did contact them via email to "verify" information on me (and in the email said I was in default) when I filed a complaint against them for revealing my personal financial situation to my employer, they stopped contacting me and my employer.

It's true all that they are looking for is leverage to get you to pay back very quickly. I found that when I appeared as someone who knew my rights, they weren't so scary and threatening anymore and worked with me.

Yes, please learn your rights with dealing with Sonic. Search Sonic in the forums and you can find more information that way. Sonic is an ongoing topic around here. A lot of us have or are dealing with them right now. They also sent a verification e-mail to my boss but it also stated that I was in default. They also violated a cease and desist order right now. I have several complaints filed against them right now with a new one in the works. Just don't let them intimidate you or play games either. They are famous for that.
