Need some advice! I had a loan with Zest Cash who is now tribally owned by Spot Loan, NOT spot on loan though. A year ago when they went tribal, I realized I had paid principal, closed bank account and notified them of this. I had heard from two different bottom feeders trying to collect and repeatedly told them that I had paid back principal and I was done with them. I had not heard anything for about 6 months ago, until today. Someone named P&B Collection called wanting to discuss Zest Cash. Zest Cash is no longer a valid company, they are now Spot Loan.

So my question is this - how do I prove in writing that since they are tribal now that I am done messing around with them. I had overpaid principal by about $500 at the time they switched to Spot Loan. I am just afraid that they are going to try and sue me or garnish since Zest Cash actually was a legit company at one time.

Sorry if this is confusing! Any advice is really appreciated!




no tribe can sue,or garnish based on tribal law,and they would have to waive their "IMMUNITY"to do that.they won't step off of tribal soil.so i wouldn't worry about it,and if they should sell it off.the place will most likely be a bottomfeeder that can't/won't do dick.as long as you gave the wage assignment revocation letter you are good.

you don't have to prove a thing.it's the bottomfeeding pile of crap that needs to prove everything.treat this P&B like any other bottomfeeder.also forget everything i posted above.

Thank you. I just don't know how I would "prove" to them that I don't owe this. I will just continue to ignore them.

I really am freaking out a little on this whole stupid mess! So these scum that are trying to collect said that they bought the account from Zest Cash to collect on. So since the collection agency "owns" the debt now, do they normally sue or can they garnish? They are saying I owe $1000 on this and I do NOT. Makes me so scared that some scum will actually win in this situation...

who is the bottomfeeder?there are alot that buy old/defaulted/illegal loans that will throw out toothless threats.if they are gonna sue you must be served and be able to answer the summons.so again who is the bottomfeeder?

again you don't have to prove a thing.the bottomfeeder must prove you owe it.once zest became spotloan they became tribal,and chances are great they will resort to illegal threats.keep us posted please.

I guess my point in all of this is that the collector is working on behalf of Zest who is not tribal. They supposedly purchased my account from Zest. So therefore, can the collection agency follow thru on suing or garnishing since they are not collecting on Spot Loan? Does that make sense??

kinda,but i know them,and pdo,cashnetusa,and advanceamerica have a habit of selling their debts to bottomfeeders.btw they can't just garnish without suing as they both go hand in hand.only the original lender can use the wage assignment.now let's go over what might happen.you get served according to your county rules.you go to court and show your records to the judge.now even though zest was legal.once they sell the debt they can't collect any amount they choose.you can dispute it in court.the judge determines you might still owe,but nowhere near the 1000.00.maybe like 228.00 plus some judges might make the collector pay the court costs for inflating the amount.now a bottomfeeder knows this and will resort to scare tactics.so it does make some sense,but as i explained legal lenders sell their debt so how can this bottomfeeder be doing anything on zests behalf?that is why they won't do shit as you can just say that zest no longer exists.hasn't for six months or more.also if they won't send at least a letter of collection they are not worth your time to worry about.you should file an AG complaint against this bottomfeeder.btw you never told me the name of said bottomfeeder.

When they called yesterday they were P&B, but on the phone they referenced they were working for Crown Assett. They did say they supposedly mailed me something, but have not received anything yet. So my concern is that they could possibly serve me papers, which is what I really don't want to deal with. UGH. Thanks again...

bottomfeeders say that all the time.if it will ease your mind go to your court clerk's website.save it to your favorites.then you can search to see if anything was filed,but i guarantee there will be nothing.that is my tool against bottomfeeders.some have called me to state there was a case against me,and i looked while i was talking to them.they really hate that,but again bottomfeeders lie all the time.again if they serve you you dispute the debt as you don't near what they say,but since i doubt they are legit i wouldn't worry.
