Serving papers/garnishing wages?

I got a phone call saying call us back with this case number so we can collect info to serve papers. . Said he wants to serve me papers, so the courts can garnish my wages. The loan was taken out in Texas. They don't garnish wages. I now live in NH. What should I do? Can he do this? So confused. Looked up garnishment laws in NH and in TX. I make less money than able to be garnished in NH. Help!!

Sounds like a scumb bag collection agency trying to scare you..register with the forums and list your loan it might be illegal.

I think they are scammers and are trying to scare you. Don’t share any personal information with them. Next time if they call you back, hang up on them.

they are a turdpile scam.a couple of facts here to back that up.

1)who the lender was

2)when the loan was taken

3)nobody calls ahead to say they are gonna serve you

4)nobody serves papers to garnish

this piece of garbage broke the law hand over them,and ignore.meaning if the number looks weirs let it go to vmail then delete it,but not before reporting it,or hang up without a word when they start their that knowing this is again a turdpile scam.

No agency will call you stating they will serve you with papers, without proper notification from the original party filing suit.

I work for an attorney. We send necessary documents to the people first before we can serve them with summons. Our process servers WILL NOT call to state you are being served.

I received the same phone call and disregarded it; The company was called National. They called my voicemail at work and cell. Also called my parents phone number. My parents told them I don't live there. I asked a friend to call the company and ask for business license number and physical address. They call themselves National.

If the loan was valid, there needs to be necessary steps to take before they can give you court order judgment and garnishment. They need to notify you in writing of action taken.

FTC will investigate the matter but you need valid address.

If you do not know the number, don't pick up the phone. Lately all I ever get is scam calls or missed calls from prepaid disconnected cell phones.

Frustrated is 100% correct. Simply ignore, if calls persist, report to your state's AG and the FTC

I am in the same scenario..... On 7/30/2013, I received a Private Number call on my cell phone. First off, I don't answer restricted calls. So this man left a voicemail and said his name was Keith Miller, not giving the office where he works for or anything, and said that his office had just received a summons with my name on it to appear in court.

He said that he'd be serving me the summons within 24hours and that he's either be coming to my home or place of employment, and I needed to make myself available, and have valid ID. He further stated that If I wasn't available, it would be a "failure to appear" and that information would be forwarded back to the original creditor and further action will take place. He stated that I could contact 855-339-2898 with any additional questions regarding this complaint, and he hung up by saying, "SEE YOU SOON"....!

Then, I receive a call from my mother that the same man called her and blatanly LIED !! He told her that "I" provided him with her number as a point of contact, and that he wanted her to give me the message that he was in my area and would be serving me papers regarding a court case! Of course, my elderly mom freaked out and said that IF she spoke with me that she would let me know, but never verified any of my information with him.

Today, I receive a call at home, unrecognized local number, and it was the same guy calling again , but stated the same thing from yesterday! This time, he says, "this is your final notice", consider yourself served and I will see you shortly at work or home.

When he calls back, and I'm quite sure he will, I will answer and politely instruct him to meet me with the papers in hand at my local police department; I will see how THAT ruffles his feathers a bit!!

I had the same thing happen to me. The guys name was Marshel Taylor but said he was from State First. The number he gave me to call was to a place called National. He said he was going to serve papers to a town in a different state where I have not lived for a couple years. They called my place of employment, my brother, mother, myself, and my dads cousin whom I have not seen in 20 years.said he needed an address to serve me on 3 complaints in curcuit court. These guys are sad. Want to charge me $1000 for a $200 loan.

Ironically- here it is 8/2/2013 and no one has shown up, to either my place of employment or home! Also, no one has called since 2 days ago.....But, I was to be expecting this man within 24hours, right?? They are very cruel people, who needs a real job......

I got a call today, where they said that I had a lawsuit pending and if I wanted to settle out of court, I needed to pay $3000. The company name they provided was a previous company I had obtain a loan with in the past, and I had paid them off, so I knew I didn't owe them any money. They asked me to confirm my information for verification, but like I told them "I don't disclose any information to any company, unless I contact the company" and they said that's fine, let me confirm, and they said your Social is, your bank account is, your address is, basically they had everything even my Drivers License! I've made reports with all local authorities, I've closed all accounts, I've signed up with Identity Theft protection, as well as other things to protect myself, my family and my identity! So people PLEASE BE CAREFUL, they are scamming people!
