SOMEBODY HELP ME WITH THIS PLEASE.....

I got a call from an atty's office this morning trying to make me a settlement offer on some payday loans....if I do not take the settlement with the option of payment arrangements they will continue to take me to court and I would have to get an atty to represent me....this is 2 payday companies who is pursuing me for 1709.95.....and they are offering me a settlement of $1,100.00 to make arrangements on.

Can they do this....is this legit....they are giving me 24 hours to decide what to do.




What are the names of the companies and what state are you in?

one is AIP, the other is ameriloan......and Tremont Financial sent paperwork to my payroll department to garnish 20% of my check until loan of 565.00 is paid. I am in the state of Tennessee

What Tremont sent was probably a wage assignment request. I would send them AND YOUR EMPLOYER a revocation of the wage assignment. Wage assignments are voluntary and can be revoke at any time. Wage garnishments can only be made thru the courts. If you haven't been sued, then you can revoke it.

Deductions of 20% of your disposable wages will begin on September 4, 2008. In order to stop this deduction you will need to provide written confirmation from the creditor that this debt has been satisfied or payment arrangements have been made. The documentation must reach my office by close of business, Thursday, August 28, 2008.

The actual letter Tremont Financial sent to me and my employer is at home so I cannot say word for word what it says at this time......As far as this atty office calling is this something they can do...should I ask them more questions....which I am wanting to do or just submit.

I can tell you that Tremont is legal, as they are licensed in NH, I believe, and that they will take you to court over the debt.

Well some kinda way my employer is acknowledging what they have sent....nothing was sent to me by the courts

I don't see how that can be a garnishment without a court order, I am almost inclined to say it's a wage assignment. You need to call your employer asap and ask them if it's a court ordered garnishment or a wage assignment that you signed when you obtained this loan. If they say a court ordered garnishment you need to ask for a copy of it, if it's a wage assignment simply write a short statement saying you are revoking their (Tremont) rights to attach your wages, then take a copy of that letter to your employer! That's what I would do if I were you.

I am currently dealing with AIP also, I have paid $144 four times for a $300 loan.. How can this illegal company sue and the application that I have with them was completely paperless, so this Tremont is representing AIP...
