Does anyone have a C and D template I can use to send to these awful PDL places? How does it work and where can I get the Fax #'s to send them.....I live in cali and have the following loans

Payday one..$295..Paid $0
One Click Cash ..$650..Paid $300 in finance
United Cash ...$390..Paid $90
One Step Cash ...$300..Paid $200
Cash Central...$390 paid $0

I recd the cali laws, but im not sure what to do next and how to send these letters, and no one seems to be writing to my other post

Welcome! You can get the C and D letter template in the do it yourself section at the top of this page. I thought I had responded to a post similiar to this one but perhaps I am mistaken. You have already listed the state you reside in, who you borrowed from and how much you have paid back. You also state that you already have the CA laws regarding these loans. We always recommend closing your bank account BEFORE you inform the PDLs of such because they will go into that account and take whatever they can. That is the first step but please read the sticky regarding closing your account. I can tell you that One Click Cash is affiliated with MNE, as is United Cash Loan, if that is what you are speaking of. They are illegal and I think that in another post I read, they have been directed to Cease and Desist loaning in CA. You have not overpaid on any of these loans so that is a good thing. One more thing, could you please verify that they are all internet loans? If you punch in the name of the PDL at the search box at the top of the page you will get the posts and find the fax numbers. Perhaps someone will come along who can give you that information directly. I am hoping that this will give you a start. Keep us posted.

Actually, I think that there was some info posted on your first post. I know that waiting is difficult but this board is monitored quite frequently and some others will be along to help you out with anything else you need. In the meantime you could start drafting that C and D letter. Just follow the template and you will cover all the aspects of this situation that need to be covered. Hang tight.

I am in New York and this is what I sent. You will have to adapt it to your State and situation. Hope this helps you get started.

To Whom it May Concern:

After doing research on internet payday loan laws in the state of New York, I have found that your internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the state of New York in general:

Complaint Instructions

A physical address is necessary, as you are no longer authorized to debit my bank account. I will not Money Gram or Western Union any payment. If no physical address is provided for me to mail payment to, no payment will be made.

Any contact must be made through the US Postal Service or email only. I need everything in writing to keep accurate records of all communication as per instruction from the state Attorney General's Office.

I prohibit you or your affiliates from contacting me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan. Once I inform you of this, you must stop the telephone contact immediately or you will be once again breaking the laws of the state of New York.

You are also hereby notified that I am revoking any voluntary wage assignment I may or may not have signed. I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes.

I am revoking your right to debit my checking account any longer. You, your company, or your affiliates are not authorized to debit my checking account from this point on. Please be aware that I have informed my financial institution of this situation and they will also be receiving a copy of this correspondence. Any further attempts at debiting my account will be rejected by my financial institution as my account has been flagged as having fraudulent activity.

I must also inform you that I have filed complaints with the Better Business Bureau, the Federal Trade Commission, my state Attorney General's Office, the New York State Banking Department. In regards to this matter, I expect a response from your company no later than 10 days from the date of this communication. This response may only come via US Postal Service or email. No telephone contact is permitted.

Please remember, I am in New York and my laws are different than yours. Just remember to adapt this to your particular situation substituting your State's name where mine is shown.
Hope this will get you on your way.

Thank you for your info. Yes, you are correct. Instituting ANY type of communication with a creditor who is trying to collect a debt starts the 7 years all over again. That is something I learned the hard way, thanks to my divorce. That is why I don't even speak to anyone who might call, unless I know exactly who they are and what they want. Personally, I am not sure about credit repair organizations and I am not sure if this is the proper forum for soliciting business. If I am wrong, someone will correct me. Good luck with your business.
