Conversations With the AG Office in Ohio

i spoke briefly this morning with the AG office regarding my complaint on ACHLoan. i am not sure she knew what is going on with internet payday loans.

she thought that all internet payday loans were backed by banks. she stated that because of this, i was bound by the contract that i signed for the state that it was signed in. although i am a citizen of ohio, i had to adhere to THAT state's law. i informed her that although some payday loans were backed by banks in the form of an installment loans (ie cashcall, thinkcash, etc), most were not. she then said "they're shady." which i of course agreed.

so my question is this. from the research i have done so far, why is she saying that i am bound by the state law of the loan, especially since the majority do not have applicable state licenses to lend? this is making things confusing for me. i want to do right...not trying to skirt out on my reponsibility...

she did say that the AG office was a small office and that they would not go after any company outside the US (such as ACHLoan). i told her that wasn't my intention. i just wanted to show that i am taking the steps needed to show that i am maing good faith attempts to pay off my balance. if at some time someone decides to be shady, i have proof that i was making all the proper steps and keeping all the proper documents.




xine. . .are you dealing with ACHLoan.com or ACHLoans.com.? They are very similiar but two different entities.

So the Ohio AG office didn't know that most internet pdls are illegal in Ohio?? That's not encouraging. :( I am about to default and am going to file complaints with the Ohio AG office. Do you think they'll help at all??? All of mine are in the US...I think.

I know some people in Ohio that had really good success working with the AG's office, so maybe you just got a person on an off day.

She said that they are legal and would have to follow their home state's laws because she thought they were backed by a bank. IF they were backed by an FDIC insured bank, then she would be correct. But since they aren't, they would need to have an Ohio license and follow the laws of Ohio.
