I have been going back and forth with ACA Recovery. I told them I would make a payment on Friday (for the entire amount due). I do not dispute the claim (we had bounced a check due to all the payday loans coming out). So after telling them that and my account going negative on Friday. I call them and tell them what happened and that I could pay it on Monday (today). I told him I could pay $75 and then the rest on the 11th. I then asked him for a detailed account review (something that shows all the charges, i.e. amount of check, fee, attorney fees, etc.). He stated he had never heard of anyone doing that. I asked him if they sent out letters that told the amount of the payment due and what the charges are for. He said they don't do that. I told him before I paid, I needed to get one. Then he states, I needed to pay in order to get one... I said fine, I will send in $75 on Monday, he told me no, I had to send in half of the payment. I told him I had $75 of it, he said he wouldn't accept it. I then asked to speak with Norman Kolinas? He informed me to give him my lawyers information, he would then call my lawyer and give them the information. I told him I wanted his direct line, he told me that a debtor could not speak with an attorney. I asked him what he was, he said he was an assistant collecter? (off the top of my head, I think thats what he said). I told him I never heard of a collection company denying payment, he said he wouldn't accept anything but half.

Does anyone know if I send in a payment for $75, if they send it back, what that means? I thought denying payment meant, I don't have to pay the debt... I am trying to pay the debit but can't pay it all at once. Any help?




Trust me, if you send them the $75 they won't send it back to you..They are just trying to get all the money up front...

Send a certified return receipt letter to Mr. Kolinas who is probably not a lawyer and require him to validate this debt pursuant to the Fair Debt Collections Act. Reqire them to provide you with the following:
The original creditor
The amount of the original debt
Proof that it is yours
How the arrived at the amount they say you owe
How much you have paid and when to not only them but the original creditor.
A copy of a letter can be found on this site by typing a search for Validation Letter. I thought it was in the DIY section but, the one I mean, isn't although it should be. When someone else with more savvy then myself reads this I am certain they will post it for you.
3rd party collectors are required to respond to your letter and answer all of those questions. They usually will only answer what is right in front of them which is Who you are and who you owe and how much they want. Not good enough. Was this from an old Pay Day Loan?

Thanks Frog! I will send it to Mr. Black, this was actually from a bounced check due to all the dang pay day loans we had coming out. So I know its my debt but the check was for $80 and they want $280?? I thought that was a little high but was going to pay it and be done but after he was rude with me (he actually started yelling, my husband could hear him across the room) I decided to ask for all the info. He didn't like that too much but I will send him a certified letter asking the above and also do a search for the validation letter! Thanks ya'll, you have helped!

How long ago did you bounce it? Depending on what state you are in, they can add up to a $200 fee( I know they can in KY and OH)

It bounced in December (I live in TX) and I don't mind paying it, I will end up paying it even if I don't receive a response but it was just the fact that I was trying to work out payments due to my situation and he wouldn't hear any of it then started yelling at me. It was just my way of trying to get under his skin bcs. him yelling at me wasn't working for him. Lol, I know, thats horrible!

Dont feel bad a few months ago I bounced 4 checks...I had a heck of a time paying them off...And I paid them off as quickly as I could because they kept sending me letters saying that they can add up to a $200 fee and bad check was a misdemeanor...They didn't care that my husband stole all my money and left me with the huge OD bill and the bounced check fees..

I am going through the same thing with ACA. I paid down most of my loan from one of those pay day loans things. They gave me the loan this loan I paid back most of the loan. I only owe $125.00 of it. I said I could pay on the 10 of April. My check was shorted by company I work for. I don't get the rest of my pay until the next pay which is two weeks from now. I called them and explain the situation. I told them that I could pay some not and take care of the rest on next week or the following week. They refused my payment saying that need all of the money, it would be given the the attorneys and they will go from there. They should not scare people like that. They did not even ask me how much I could pay.
