RECIEVED A SUMMONS TO GO TO COURT ON 8/4/08 FROM MIDLAND COLLECTIONS AGENCY BUT ITS FOR MY MOTHER WHO DOESN'T LIVE WITH ME AND IS NOW IN A NURSING HOME DUE TO A STROKE. WHAT CAN I DO ON HER BEHALF?

Do you have power of attorney? When was the last time she paid on the account? What state does she reside in?

If the summons was to your mother then I think that would be improper service since they served you at your home and not her and depending on where she lives now it might be improper venue. You need to check the SOL on the debt too since they might be suing you for something that is really old. If you mother has no assets then their suit will not do them any good anyway but I would still try to fight it.

Before you say it's improper venue, check you laws in your jurisdiction. In my area, a family member can accept a summons for you, as can a roomate or someone else at your house. It's considered properly served in that case.
