The DV letter on this forum asks the CA for a "Copy of the original credit card application establishing the debt between the creditor and me. This is also basic contract law" as part of debt validation under the fdcpa.

I got a response from the CA and they say that they are not required under the FDCPA to provide me with the application to validate the debt. I also read the FDCPA myself and no where does it seem to require the above either.

Am I missing something?

Hello senton and welcome to the community! :) Send them another debt validation letter with the following information:

I'm sure others will be along shortly to advise you, but that's what I would do. :)

Can you list the source of the above section? Is it in the fdcpa?

I posted this a few days ago:

Short of the Discovery phase of litigation, it is very rare for a CA to provide a copy of the original contract.

It is case law, I found it on this site here, http://www.debtconsolidationcare.com/validation.html. I obtained the actual case law at the Credit Infocenter.
