Hey Guys,


I had a charged off account from Rooms to Go in 2011 and the account was sold to an Admin Recovery, LLC. Admin is now on my credit report, but I just received a call from another collection agency, Velocity Investments, who now claim they have my account (I've already DV'd them).


What can I do about Admin Recovery, since they are no longer holders of this account, so it seems? FYI...it's still within SOL. I DV'd Admin Recovery and all they sent back was a statement from Rooms to Go. That wasn't good enough, I wanted contracts, complete payment history, the works, but never heard back. I have my Admin Recovery Green Card.

Could be that the first collection agency assigned it to this new one. If so, it's reporting correctly.

Also, you're not entitled to complete payment history. You should be asking for the original signed contract for the alleged debt.

That's the thing. This company contacted me back in early 2011. I asked for proper validation (sent via email and CMRR) and all the sent me was a form letter stating I owed $1300. Ihaven't received any contracts, accounting history, nothing.
And now they're on my report and I think that's a violation since they hadn't validated. I've disputed with all 3 bureaus and it came back verified...blech! I contacted the FTC and awaiting results, as well as the NY BBB.
Not sure what I should do next. And now I have a new company, Velocity Investments asking for the same $1300 and of course I DV'd them as well. I have yet to hear ANYTHING from them either.

If this account has been assingned your DVing could backfire and cause you to be sued very quickly. You are proving yourself to be a difficult debtor. Have you called rooms to go???

I've called Rooms to Go and got the run around....the customer service representative couldn't verify who had my account. I asked for a manager and was literally on hold for 15 minutes. Called back and got the same thing.

I don't think I'm being a difficult debtor all. I've been doing my reseach via this board and others on what it is I need to ask for when DVing, because I didn't know at first. Soaplady, I'm confused on why you say that the CAs don't have to give consumers their payment history, when everything I've seen on this board and practically everywhere else, says to ask for it.

My DV letter, asked for the following:

[INDENT][/INDENT]??? Provide a full accounting history showing how you calculated the alleged debt/current balance.

[INDENT][/INDENT]??? Provide me with copies of any papers that show I agreed to pay you or the original creditor what you say I owe specifically, an original signed contract bearing my signature.

[INDENT][/INDENT]??? Prove the Statute of Limitations has not expired on this account.

As of today, I've received NADA, except for a letter that says you owe $1325.

FYI...I've DV'd them twice going back to Apr 2011 and again in June 2011 and didn't receive replies, other than how much I owe. I figured that was it.

It's only now that I've noticed they were on my credit report and from what I understand, they aren't supposed to report, if they haven't validated.

If anyone should sue, it should be me, but I'm not the litigious type and haven't threatened to do so, thus far.

Where in the FD (or by what precedent) has it been established that they need to provide a copy of the original signed contract? My understanding is that there has been a very loose definition set as to what constitutes validation. So if I'm wrong, I'm curious what i've missed. Thanks in advance.

How can you be litigious if you dont even know the laws? You dont know the difference between an assinged debt and a sold debt. They are not required to send you this. The CA has an amount placed with them..,.,there are no calculations for them to send you. Rooms to Go does all of that...,if you want that, ask Rooms to Go for it.

Did you dispute the debt?? Did you actually sign a card holder agreement or was it done by an esignature. You purchased furniture...how did you sign for it?? A statement showing were you made payments will hold up in court.

You ARE showing yourself to be a difficult debtor. Sounds like the CA's are simply closing and returning your accounts once you DVing them....it is not work the hassle. You have now been thru two placements. Rooms to Go will more than likely assign your account to an attorney to be sued on.

I do appreciate the knowledge being offered and am definitely open to being helped and constructively criticized, but it seems like you're attacking me, when I'm here openly asking for guidance.

I don't claim to be a lawyer or have extensive knowledge of these laws, hence my trying to do research, by coming to this board and many others. I may mess up along the way, and I would hope that a user, such as myself, can come here looking for constructive criticism, rather than feeling like they're being attacked for no reason.

Now...I've read the FDCPA and it says that the CA must produce the amount of debt owed, which they've provided and nothing else. No contract, nothing, just the amount.

If it was a mistake in asking for payment history, I get that and hope it doesn't come back to haunt me, because I did admittedly copy a letter from this forum. It wasn't a 2 page letter, but 2 simple paragraphs, asking for the aforementioned information. But, it made sense to me to ask for payment/accounting history, just to be sure they weren't adding bogus charges to the alleged balance.
