Hi Carl

I believe that whenever an organization grows bigger, it's necessary to maintain an overall good relation with each of its clients. But there may be times that it has some ups and downs in some phases and fails to maintain that healthy relation with an individual. It will possibly try to recuperate its losses otherwise it may not be able to prosper in the long run.

Roxette:

Just to let you know, Asset Acceptance is an unscrupulous company. I have filed complaints with the California District Attorney and the FTC. They were one of about half dozen collection agencies which tried to collect from me on a bogus debt.

They erroniously claimed I had an account in collection, in the amount of $505.00 said to be owed to Holiday Health Spa of California. Also, arrow financial services tried to collect $1600 from me on the same account. At the time, I wrote a letter, demanding they cease all collection activities. The harrassing communications from these two agencies stopped. However, this was followed up by a string of at least half dozen collection agencies harassing me by telephone and mail (They must have sold the account).

This is a fraudulent claim. The only time I ever had an account with Holiday Health Spa was back in 1992. I have not had an account with them since that time, as Asset and the others claimed. Furthermore, to my knowledge I never owed Holiday Health Spa money, nor has any claim against me for said amounts ever shown up previously on my credit reports. This claim is also in direct violation of California State code CC Section 1812.88, in which a health spa must advise me that a debt is being assigned for collection. None was ever issued.

Fortunately, I saw a news program which reported this type of claim as a scam. As I understand it, certain unscrupulous collection agencies have preyed upon and collected sums of money from many innocent victims, representing bogus claims such as this one. According to the report, these agencies are under investigation by the consumer fraud division of the FTC.

This did not stop Asset Acceptance and Arrow Financial Services from entering these false claims in two of three credit reporting agencies. After countless letters, I was finally able to get them removed (You're guilty until proven innocent). However, there are what is deemed "permissible" entries on my TransUnion credit report from both of these agencies, the purpose of which is described as "collection." As I understand it, these entries will stay on my credit report for two years. I am currently fighting to get them removed.

Just to let you know, other than these entries, my credit record is pristine. Am I angry? You bet!

I seriously think this company is either extremely disorganized or very unscrupulous! I just received a letter from them for a collection on something I have never had! I got a collection letter for a lane bryant account. Let me just tell you that this probably is a great service but not one that I need! I have never been in this store, to their website or anything else! I have sent a nasty letter. But this certainly explains why a credit card I have had for years recently jacked up my great percentage rate!

You will find many more posts in this forum that gives a description of Asset Acceptance's illegal nature of business.

Know your federal rights and send a DV letter to the company. They will either have to prove that the said debt is legitimate or will have to step back from contacting you further.

You can also involve your attorney in this process.

This is the last black mark on my credit report, due to fall off in 01/07, 13 months from now. Currenty it is listed as 120 days past due, or collection. It was charged off by the original creditor Household bank in 01/00, date of last activity and past the Statue of Limitions. Question is if I sent them a debt validation request or to get them to correct, am I inviting a lawsuit? From these posts it makes me just want to ignore them, but it is listed wrong, and for the next 13 months I can't get security clearance from my work due to this "debt" I don't legally owe.

Hi Timbo

Welcome to the forums.

Disputing the items does not enter you in a lawsuit. As per the fdcpa laws, after the debt validation is sent to you, the collectors give you 30 days time to dispute the debt. If you do not dispute, the validation is considered accurate and further actions are taken.

Disputing the item also proves your defense regarding this debt validation. Otherwise you might have to pay something that you actually do not owe. Please read this article to know why it is important to dispute the items.

I received a letter from Asset Acceptance that is to my address but to a name that is a variation of my (for example, if my name were Mary Ann, the letter says Marilyn). The collections letter they sent is for a company that I have never done business with and nothing negative is showing up on my credit report. Should I even try to address this issue or just ignore it?
