  • Harassing calls: First Source Advantage LLC was making harassing calls to a consumer. When the consumer stopped answering calls, the company called his family repeatedly and spoke to them very rudely. Even after repeated requests to stop their calls, First Source Advantage LLC didn't refrain from harassing the consumer.
  • Making false claims: Some consumers have claimed that the company might not be legitimate. According to those consumers, First Source Advantage LLC has been making false claims to debtors without being able to validate the debts they owe.
  • Unauthorized withdrawal of funds: First Source Advantage has withdrawn money from consumers' checking accounts without authorization and without sending a monthly billing statement.
  • Problem with payments: A consumer had a medical debt which was sent into collections because one of his payments was not recorded. First Source Advantage was the collection agency in charge of the debt. A representative from the company made arrangement for payment of the unrecorded bill. One of the customer representatives from First Source Advantage didn't like the arrangement and started to threaten the consumer over phone. The consumer finally contacted his creditor who asked the collection agency to stop their harassment. The creditor also asked the consumer to make payments directly to him.
  • Adding extra charges without reason: Some consumers claim that First Source Advantage has been charging late fees, over-limit charges, and other fees every month, even though they have been sending payments twice a month.

I received a call about 2 weeks ago from First Source Advantage llc, which is a collection agency used by Capital One. They informed me that Capital One was preparing to file a lawsuit against me for my balance, lawyer fees, etc. The woman on the other line asked me what I wanted to do and I asked if it was possible to set up some sort of arrangement. I said that I could post-date checks in the amount of $252 for September 30 and October 15, and $564 for October 31.

I was expecting the amount of $252 to be taken out of my account and not $564, until I received a notice from my bank stating that the substitute check of $564 was returned. I won't be able to cover the $564 right now, and I don't want to face an legal problems for the returned check.

I have hit full blown panic mode because I have never written a bad check before. Should I contact First Source since it was their mistake? Please help!

Go to the bank and close the account tomorrow. Pay what ever fee that might apply because First Source now has your bank info and will continually attempt to take money.

They are in violation because they have to notify you prior to depositing a post dated check.

If you are have any outstanding checks tell the bank and put a stop payment on all checks except the ones you have outstanding that are not to First and freeze all debits.

Did you have a written agreement with them?

Did you date the checks for 9/30, 10/15, 10/31?

Did you by chance photocopy them?

Send them a debt validation letter demanding that they prove the debt and explain that they violated the original agreement by depositing the wrong check.

No, there was no written agreement. I didn't even send in physical checks to First source advantage llc. I knew it was a horrible decision to post-date checks, especially without sending and dating them myself.

Do as Celluair mentioned, close that account at once! Don't ever agree to making payments unless you have a written agreement.

Speak to your bank, it is a simple fact that the withdrawal was not authorized by you, you NEVER authorized that amount. Your bank will more then likely be very helpful and reverse any fees that came with that. Since it was an electronic transaction you can revoke all further rights to debit...send them a certified letter revoking this right. I read that this is enforceable, can't recall exactly where...but I think it was a federal level law.

Okay my last question is, should I contact the collection agency by phone and let them know? I just don't want to start receiving phone calls/threats from them.

If you don't want the collection agency to contact you anymore, send them a letter stating so. Also, did you send the collection agency a debt dispute/verification letter (as your are allowed to do under the Fair Debt Collection Practices Act)? If not, write, "I dispute the validity of this debt and request that you provide me with verification." Send the letter via certified mail, return receipt requested and via regular mail and make a copy for your records.

yes he is absolutly correct. i worked for the company and you should have recieved a letter. Definatly you should write a letter stating that you want the calls to stop it is called a cease and desist letter. Also if they call your job and you ask them to stop and you dont than that is also against the law :)

Your bank will reverse the transaction, since the amount was unauthorized. I ran into this problem several years ago and was so thrilled to hear that they were able to do that for me. They cannot, however, reverse a debit card transaction.

I have been having a problem with first source advantage llc as well,, but my problem goes a bit further. They have been trying to get a hold of me, but after hearing their threats, I decided to not answer their calls. In turn, they have called my brother 3 times, and my parents, who are elderly and in a different state, 6 times now. The have made contact with my parents and said to my father, "Don't you care what you son is doing to his credit." Even after my father informed them not to ever call his nuber again,, about a month and a half later, they call again. Is there anything I can do to get them in trouble for harrasment? Any helpfull advice would be greatly appreciated.
